Second Mortgage.Behind Your First Loan Rather Than in Place of It.

A second mortgage leaves your existing loan untouched and sits behind it on the title. That is useful when the first loan is worth protecting, and expensive when it is not. For most people a refinance is the cheaper answer, and we will tell you which one you are.

What Is a Second Mortgage and How Does It Work?

A second mortgage is a further loan secured against a property that already has a mortgage on it. Your existing loan stays where it is, and the new lender registers behind it. Because they are repaid only after the first lender is repaid in full, a second mortgage is priced for its position rather than for your credit quality.

In New South Wales that position is a matter of the register rather than of agreement. Section 36 of the Real Property Act 1900 provides that dealings take priority over one another according to the order of registration, and not according to the dates of the dealings. Whoever registered first is first, whatever the paperwork says.

The honest framing is that a second mortgage is a specific tool for a specific problem: you need funds and there is a reason not to disturb the first loan. Where there is no such reason, releasing the same equity through a refinance is usually cheaper and involves one lender instead of two.

When a Second Mortgage Is Actually the Right Tool

Six situations account for most second mortgage enquiries. In two of them the answer is usually to refinance instead, and we will say which.

Your first loan is on a fixed rate you do not want to break

The clearest case for the product. Breaking a fixed rate can cost more than the difference in pricing on a smaller second loan, so leaving the first alone is the cheaper path. The break cost is the number that decides it, and only your current lender can quote it.

You need funds faster than a refinance can settle

A refinance moves the whole loan and takes as long as it takes. Where timing genuinely drives the decision, a second mortgage can be the shorter path. Worth testing honestly, because urgency is often assumed rather than real.

Funding a renovation without touching a good first loan

Where the work is substantial and staged, compare this against a construction or renovation loan, which draws against the build rather than lending the whole amount up front.

Releasing equity for an investment deposit

Usually better done through a cash-out refinance taken as a separate split, so deductible and private borrowing never mix. A second mortgage can achieve the same separation, but it is rarely the cheaper way to do it.

Your first lender will not lend you any more

A common trigger and a warning sign worth reading. Sometimes it is a policy limit and another lender would fund the whole thing. Sometimes it is a serviceability answer, in which case adding a second debt is the wrong response to it.

Consolidating short-term debt against the house

Proceed carefully. ASIC notes the rate may be lower but you could pay more in interest and fees in the long run, and if you cannot pay, the home you put up as security may be sold. Short debts do not belong on long loans.

Priority Set by order of registration under the Real Property Act, not by the date you signed
Consent Your first mortgagee usually has to agree, and is not obliged to
Regulation Decided by what the money is used for, not by what the loan is called

Built on 25 Years in Australian Finance

Joseph Sukkar started in finance in 2000 and founded Intellect Finance in Penrith in 2005. Since then the team has arranged more than 6,500 loans for clients across Australia, from first homes to complex commercial and asset finance.

Residential lending sits with Moufid, our Head of Residential Lending, who talks a fair number of people out of this particular product. A second mortgage is a narrow tool and it is sold well outside the situations it suits, so the useful work happens before anything is lodged. That means costing a full refinance against it, including any break cost on the first loan, and establishing whether your first mortgagee will consent at all. Where the refinance wins we say so and point you at it.

Part of Our 100+ Lender Panel

The names most people recognise are residential lenders. Much of what we arrange runs through funders that do not advertise to the public. Accreditation with a lender is not an endorsement by it, and which lender suits you is decided by your file rather than by who is on this list.

Not Sure Which One You Need?

Fifteen minutes costs a refinance against a second mortgage. No credit check.

A Second Mortgage Is Priced by Its Place in the Queue and the Queue Is the Register

Everything difficult about a second mortgage follows from one fact: somebody else is in front of you on the title, and being second is not a matter of opinion or agreement. Six things follow from that, and they decide whether this is the right tool or an expensive way to solve the wrong problem.

01

Priority runs by registration rather than by signature

Section 36 of the Real Property Act 1900 provides that the order of registration is the order in which dealings were lodged in registrable form, and that dealings take priority over one another according to the order of registration and not according to their dates. Whoever registers first is first. That single rule sets the price of everything that follows.

02

Your first lender usually has to agree and is not obliged to

Most first mortgagees require consent before another mortgage is registered behind them. It is not automatic, it is not always granted, and it can carry a fee and a wait. A second mortgage your existing lender will not consent to is not a plan, so this is worth establishing at the start rather than after an application is in.

03

The lender prices the position rather than the borrower

In a sale the first mortgagee is paid in full before the second sees anything, so the second lender’s exposure depends on someone else’s debt as much as on your file. That is why a strong borrower can still be quoted terms that look nothing like their first loan. It is not a judgement on you.

04

It makes refinancing the first loan harder later

To move the first loan you generally need the second discharged at settlement, or the second lender to agree to rank behind the incoming first mortgage. Neither is automatic and both take time and coordination. If a refinance is likely within a couple of years, plan the exit before you arrange the entry.

05

Whether it is regulated depends on the purpose rather than the label

The National Credit Code applies to credit provided wholly or predominantly for personal, domestic or household purposes, or to purchase, renovate or improve residential property for investment. It is the use of the money that decides, not the name of the product. If a lender is treating a loan against your home as business purpose, ask why and get the answer in writing.

06

Mixed use follows you for the life of the loan

Where borrowed funds are used partly for private and partly for income-producing purposes, the ATO requires the interest to be apportioned in that ratio, and every repayment to be apportioned across both portions for the life of the loan. You cannot pay down the private half first. Keep the purposes separate from the start.

Checked 1 September 2026. Sources: registration order and priority, section 36 of the Real Property Act 1900 (NSW), a New South Wales position; the scope of the National Credit Code, ASIC; apportionment of interest and repayments on mixed-purpose borrowing, the ATO; debt consolidation warnings, ASIC Moneysmart; lenders mortgage insurance, Moneysmart; Best Interests Duty, ASIC Regulatory Guide 273. First mortgagee consent, second mortgage pricing and discharge arrangements are lender practice and vary. Nothing here is legal or tax advice. Everything else on this page is described in the important information at the foot of the page.

The number that decides this is not the second mortgage rate. It is the total cost of a second mortgage against the total cost of refinancing everything, including any break cost on the first loan. Ask us to run both.

Second Mortgage or Refinance the Whole Loan?

This is the only question that matters here, and for most people it does not go the way this page sells. Both sides, properly.

Refinance

Move the whole loan and release equity

  • One lender, one loan, one set of repayments, and pricing that reflects your file rather than your position
  • No consent to negotiate with an existing lender, because they are being repaid
  • You can restructure at the same time, with the release taken as a separate split
  • Break costs if the first loan is fixed, plus discharge and registration fees
  • Your whole position is reassessed against current rules, not just the new borrowing
Second

Leave the first loan and add behind it

  • A fixed rate or favourable first loan stays exactly as it is, with no break cost
  • Only the new borrowing is assessed, not your entire existing facility
  • Can be the shorter path where timing genuinely drives the decision
  • Priced for the position, so usually more expensive than the same money released by refinancing
  • Two lenders, consent to obtain, and a harder refinance later

For most people who ask us about a second mortgage, refinancing is the better answer. Unless the first loan is fixed at a rate worth protecting, or the timing genuinely will not stretch, releasing the same equity through one lender is usually cheaper and always simpler.

That is the smaller transaction for us and it sits on a different page, which is where we will send you. We would rather arrange one clean facility than put a second lender behind a first and then spend two years untangling it when you want to move.

There is one case where a second mortgage is clearly wrong, and it is the most common reason people ask. If your first lender has declined to lend you more because the servicing does not work, a second mortgage does not fix that. It adds a second repayment to a position that could not carry the first one, at a higher cost, secured against your home.

If short-term debt is the pressure, talk to us before you secure it against the house, and consider the free National Debt Helpline on 1800 007 007 first. That call costs you nothing and it earns us nothing.

Ask Us Which One Is Actually Cheaper

We will cost a refinance against a second mortgage on your numbers, including when the first loan is fixed at a rate worth keeping. Fifteen minutes.

Most Second Mortgage Enquiries Should Not End in a Second Mortgage

The product exists for a narrow set of situations and it is sold well outside them. The useful work is establishing which one you are in before anybody lodges anything.

We Cost the Refinance First

Break cost on the existing loan, discharge and registration fees, and the total cost of releasing the same money through one lender. If that number wins, we tell you and you go and do that instead. It is the answer more often than not.

We Establish Consent Before Anything Is Lodged

Whether your first mortgagee will consent, on what terms and in what timeframe, is the thing that decides whether this is possible at all. Finding out after an application has marked your credit file is an expensive way to learn it.

No Fee. Not Even Clawback.

We do not charge you for the comparison, the structuring or the application, on any loan type. If you discharge the loan early we wear the clawback ourselves rather than invoicing you for it, which plenty of brokers do. Lenders pay a commission on settlement, disclosed to you in writing before any work begins.

Legally On Your Side

Where the credit is for personal, domestic or household purposes or for a residential investment property, it is regulated consumer credit and Best Interests Duty applies. We must act in your interests and give them priority where they conflict with ours. Those obligations have applied to mortgage brokers since 1 January 2021.

How a Second Mortgage Comes Together

Four steps, and the first two often end the conversation with a better answer.

  1. 15 minutes

What the money is for and what the first loan is doing

The purpose, the amount, what you owe, what the property is worth, and whether the first loan is fixed. No documents and no credit check. The purpose also decides whether the credit is regulated, which changes your protections.

  2. We model

The refinance costed properly against it

Break cost, discharge and registration fees, and the total cost of releasing the same amount through one lender instead of two. This is the comparison that decides it, and it is the one nobody selling a second mortgage volunteers.

  3. You gather

    Documents

Two loans means two sets of information. We confirm exactly what your chosen lender wants before you go looking for any of it.

    • Photo identification
    • Two recent payslips
    • Latest tax return or group certificate
    • Six months of statements on the existing loan
    • Current loan payout or balance figure
    • Rates notice for the property
    • Evidence of what the funds are for
    • Details of existing debts and card limits
  4. We manage

    Consent then approval then registration

We seek the first mortgagee’s consent, manage the valuation and conditions, and coordinate registration so the ranking is what everyone expects. We also document how the second mortgage comes off when you next refinance, because that is the part people wish they had asked about.

Second Mortgage FAQs

The questions home owners ask us most often before getting in touch.

What is a second mortgage?

A second mortgage is a further loan secured against a property that already has a mortgage on it. Your existing loan stays exactly where it is. The new lender registers a second mortgage behind it, which means they are repaid only after the first lender has been repaid in full. That ranking is the whole product, and it is why the terms differ from a first mortgage.

Who gets paid first if the property is sold?

The first mortgagee, in full, before the second mortgagee receives anything. In New South Wales section 36 of the Real Property Act 1900 provides that dealings are entitled to priority over one another according to the order of registration, and not according to the dates of the dealings. Priority is decided by the register, not by when you signed.

Do I need my current lender’s permission?

In practice, usually yes. Most first mortgagees require their consent before a second mortgage is registered behind them, and they are not obliged to give it. Whether consent is granted, what it costs and how long it takes are all matters for your existing lender. This is one of the first things worth establishing, because a second mortgage the first lender will not consent to is not a plan.

Is a second mortgage cheaper than refinancing?

Often not. A second mortgage is priced for its position rather than for your credit quality, because the lender is behind someone else in a sale. For most borrowers with a sound first loan, refinancing the whole thing and releasing equity that way is cheaper and simpler. A second mortgage earns its place when the first loan is worth protecting, for instance where breaking a fixed rate would cost more than the difference.

Will a second mortgage stop me refinancing later?

It makes it harder. To refinance the first loan you generally need the second mortgage discharged at the same time, or the second lender to agree to sit behind the new first mortgage. Neither is automatic and both take time. If you expect to refinance in the next year or two, work out how the second mortgage comes off before you put it on.

Is a second mortgage on my home regulated consumer credit?

It depends on what the money is used for, not on what the loan is called. The National Credit Code applies to credit provided wholly or predominantly for personal, domestic or household purposes, or to purchase, renovate or improve residential property for investment. If your second mortgage falls inside that, the Code and Best Interests Duty apply. If a lender treats your loan as business purpose, ask why, and get the answer in writing before you sign.

Can I claim the interest on a second mortgage?

Only to the extent the borrowed money produces assessable income. The ATO requires interest on a loan used for both private and income-producing purposes to be apportioned in that ratio, and every repayment must be apportioned across both portions for the life of the loan. That is why a second mortgage used partly for private spending is worth structuring carefully. We are not tax agents.

Does Best Interests Duty apply to a second mortgage?

Yes, where the credit is for personal, domestic or household purposes or for a residential investment property. That is regulated consumer credit under the National Consumer Credit Protection Act 2009, so we are legally required to act in your best interests and, where interests conflict, to give priority to yours. Those obligations have applied to mortgage brokers since 1 January 2021.

Where credit is provided for personal, domestic or household purposes, or for the purchase or improvement of residential investment property, it is regulated consumer credit and Intellect Finance is legally required to act in your best interests under the Best Interests Duty in the National Consumer Credit Protection Act. General information only. The content on this page is general in nature and does not take into account your objectives, financial situation or needs. It is not credit assistance, financial advice, legal advice or tax advice, and it is not an offer of credit. You should consider whether it is appropriate for you and seek your own advice before acting on it.

Your home is the security, and that is the risk. A second mortgage is secured against your property in the same way your first loan is. If you cannot meet the repayments, the property may be sold to recover what is owed, and the first mortgagee is repaid before the second. Securing short-term or unsecured debt against your home converts a debt you could have written off into one that can cost you the house. If debt is the pressure, the free National Debt Helpline is available on 1800 007 007.

Priority is a legal question and it is state based. The registration and priority rules described on this page are from the Real Property Act 1900 (NSW) and apply in New South Wales. Every other state and territory has its own Torrens legislation. How priority operates in your particular transaction, and the effect of any consent or priority arrangement between lenders, is a matter for your solicitor or conveyancer. We are not solicitors or conveyancers.

Whether the Code applies depends on the purpose of the credit. The National Credit Code applies to credit provided wholly or predominantly for personal, domestic or household purposes, or to purchase, renovate or improve residential property for investment. Credit provided for business purposes sits outside that framework and carries different protections. If you are unsure which applies to your loan, ask the lender and obtain the answer in writing before you sign.

Tax positions are not ours to give. Deductibility, apportionment of interest and repayments on mixed-purpose borrowing, and the treatment of borrowing expenses are matters for a registered tax agent and the Australian Taxation Office. We are not registered tax agents and we do not provide tax advice.

Nothing here is a guarantee. Loan approval, borrowing capacity, pricing, loan to value ratios, first mortgagee consent, discharge arrangements, timeframes and eligibility are determined by individual lenders, not by us. Second mortgage pricing, terms and availability are lender-specific and are not published on this page. They differ between lenders and change over time. Break costs on an existing loan can only be quoted by the lender that holds it. Any figure or timeframe on this page is indicative and is not a quote, an offer, or a prediction of your outcome.

Best Interests Duty. Where credit is provided for personal, domestic or household purposes, or for the purchase or improvement of residential investment property, it is regulated consumer credit under the National Consumer Credit Protection Act 2009. When providing credit assistance in relation to these products, Intellect Finance is required to act in your best interests and, where there is a conflict of interest, to give priority to your interests. These obligations have applied to mortgage brokers since 1 January 2021.

How we are paid. Intellect Finance does not charge borrowers a fee for arranging finance, and does not charge a clawback fee where a loan is discharged early. Lenders pay us a commission on settlement. The basis of that commission is disclosed to you in writing in our Credit Guide before any credit assistance is provided.
